I didn’t get charged tax here in California. I’m sure it’s going to happen eventually.

I live in FL so I’ve been paying tax for a long time.

:(

I got charged sales tax in GA, but I thought it was because I bought a car cover through AG. I was kinda surprised but figured one day they would start charging sales tax like Amazon.

FAQs related to registration requirement for businesses with no physical presence in NYS
Why is this law being enforced now?

This provision has been in the New York State Tax Law for decades. However, it could not be enforced due to the United States Supreme Court’s ruling in Quill Corp. v. North Dakota [504 U.S. 298 (1992)]. This ruling generally provided that a business must have some physical presence in a state for that state to require the business to collect its sales tax. The decision in South Dakota v. Wayfair [138 S. Ct. 2080 (2018)], eliminated this physical presence test, so this longstanding provision in the Tax Law automatically became operative and enforceable.

What is the effective date of this law?

The law became effective on June 21, 2018, the date of the United States Supreme Court decision in Wayfair.

Will this result in a tax increase on New Yorkers?

No. Sales or use tax is owed by a New York purchaser on a taxable sale or purchase even if a business doesn’t collect it at the time of sale. This law increases the number of businesses that need to start collecting New York State sales tax, but doesn’t impose a new tax liability. See Tax Bulletin Use Tax for Individuals (including Estates and Trusts) (TB-ST-913).

What are the specific provisions in this law?

A business with no physical presence in New York who regularly or systematically solicits business in New York State by any means and makes taxable sales of tangible personal property to persons in the state is required to register as a sales tax vendor. As a vendor, you must collect and remit sales tax as applicable on your New York State sales.

This happened to me when I ordered something from TRC last year. I have no problem paying sales tax, I just thought it was a mistake at the time, so I questioned it. They weren't happy about it; I guess for a company like PBMG it's a lot of extra work to keep track of 50 states sales tax law vs. just the state your business is in.

I have never been charged sales tax? Oh, nevermind I live in NH so I get to pay for everything through our property tax :(

New York's Online Sales Tax law went into effect in January, 2019. There was no grace period beyond the fact that we enjoyed an 8.625% discount on purchases for over 15 years already. ;-)

well you know is was going to happen at some point and it's really not PBMG's fault and it is what it is. so lets raise the percentage of the biggest sale you have from 25% to 30% (or higher) to offset the sales tax.. ;)

Hi Bobby - I am in NJ and have recently been charged tax on the last 10+ orders yet NJ is not listed above. Is the list above wrong or have I been charged tax and should not have?

Thanks!

No way I’ve been here for like 98 years. The shadow man won’t let me die. If you don’t let me get an invite I’m gonna be peering through the bushes (and sneezing cause pollen is crazy) .

I don’t have bike boots but I can throw on my pair of NMDs and look real freakin hip.
