Having New T-Shirts Made

Ok, so I'm looking into having some new T-shirts made with the new logo on the back. I want to put something on the front of them such as the 3 square design, "Eat - Sleep - Detail" and "I (Heart Shape) Detailing.

My question is are these copyrighted? If so, how do you find the owner of the copyright so you can get permission to have them put on your shirts? I've seen the first design on several different company shirts and I've only seen the second design on 2 companies.

I would like to put the 1st design on a black or white T-shirt for my male customers while the second on either a black or pink T-shirt for my female customers.

I don't know if I'd sell them or not, my main purpose is to include them in a kit for the new customers who come to my new location and purchase my Premium Detail Package. The kit will be in a Gift bag with my logo, and in it will be my shirt, a MF Towel, quick detailer spray, and a coupon for $20 off there next Premium Detail.
I should add that this isn't a permanent thing, I'm only including it in my Premium Package which starts at $250 and I'm only doing 50 kits. That along with my quality of work should spread word of mouth like a wild fire.
 
Thats a really neat idea, hope that turns out well for you. Show us pics if these shirts ever come through :)
 
Great idea.
As you stated 'Eat, Sleep, Detail' is offered by other companies, don't know if it's intelectual property, copyrighted or trademarked without getting lawyers involved.........................:confused:
 
Does anyone know if these are copyrighted? I've emailed the companies I know of who use them but no response.

If I get no response should I go ahead and make them?
 
I'd say since you're not selling them and not making a lot of them go for it. If you were to offer them online then you may want to look further into copyright infringements.
 
Here's my "not legal" legal advice:

You said "multiple companies" are using these slogans. That implies that either A) it's not a trademark or B) several companies are ignoring the law.

Are you looking to use the shirts when you detail or are you looking to sell them? Most likely, if someone has it copyrighted and finds out you're using it, they're going to send you a cease and desist letter telling you to stop using the shirts. If you stop, that'll be the end of it.

Unless you're trying to go Nationwide with the shirts, I would make them anyways. But a little research doesn't hurt, so start with the U.S. Patent & Trademark Office. USPTO and the trademark search is here.

Also, asking an intellectual property lawyer is always a wise idea.
 
Thanks OMRebel, I did the search and there is no copy right on either. I'm not going National so I guess I was putting more thought than it needed.
i would sell them if a customer wanted to buy them but they'll mostly be used in the shop.

Usually when intellectual property is concerned the main thing they clamp down on is 'selling for profit'. Secondary is using said property as advertisment. While it's not 'open' advertisment per say, it is advertisment. OTOH you'll likely be OK considering it is literally impossible to think you'd run into the original owner of the property anywhere you might ever go.

Just thinking out loud here boss. ;)

The rule is you can print anything that is not copyrighted or trademarked. Normally they will have a c, trademarked, or r (all inside a small circle) in the design. This is always a tricky situation and something that you have to deal with daily in the screen-printing industry. If you want to send the design to me @ [email protected] I will see if I can find anything out for you. Not sure if I can be of any help or not but I am willing to give it a try. Let me know which companies use the design if you decide to send it to me?
