Hey guys,

I just want to vent but also ask if anyone on here has contested speeding tickets and won? When I was in high school I was hit with several speeding tickets. I plead guilty in court, got the fine reduced, paid them, and also attended traffic school. However, now that I am 30, I feel more educated, wiser, and I am a bit annoyed at having to do this and feel like contesting because these greedy cops are only out to make money! I am amazed that you can actually contest them and win from the little researching I've done.

I read that only 5% of people actually contest them and 50% win the case because the cop was too lazy to show up in court or they got moved to a different area, thereby dismissing the ticket.

Also, read you can do a "Trial by Written Declaration" which means you mail your letter and never need to show up to court. To my amazement this has produced the best results in beating speeding tickets. The reason? Cops get paid overtime to show up in court but when they are hit by a written declaration they have to write a letter defending the case and don't get paid anything for their time.

So anybody have anything to post on this? Any input appreciated. Guess I'm looking for people who have contested speeding tickets and won.

your best bet is just to pay the tickets and just try to watch your speed from here on out. if you fight it in court and the cop shows up, your chances are pretty slim to none as the judge will side with the officer. if you can explore other avenues where you think you can beat them, more power to you but it's highly unlikely. just being truthful, good luck to you...

I witness my friend get his 6 points dropped down to 2 because he kept pushing the date because we live in NJ and he got the ticket in upstate NY.

He pushed it back 3 times and then we went to court because it was on the way to the casino, the cop didn't show up so the points dropped and he only had to pay for the ticket.

He thought he was going have to pay 500+ to get rid of those 4 points. I guess he got lucky the cop didn't show. But you can also rely on the cop not showing.

Going on that theory I contested one where the airborne officer was based 200 miles away. He showed up with the ground-pounder. I made a convincing enough argument that the two cops had doubt that something got screwed up. Judge wasn't equally convinced enough but he zeroed out the fine.

It's all about revenue. Always has been, always will be. Some small municipalities in OH that have a 1/4 mile of Interstate in their juridiction have a fleet of cruisers sitting their 24/7 and fund the entire township from the proceeds.

I'm one of those people that gets caught if I'm doing anything I'm not supposed to. Got written up for 56 in a 55 once. I figure if I do the crime I better be prepared to do the time. I'm not in much of a hurry anymore.

obviously you didn't get pulled over for no reason, so just accept that you're at fault, move on, and try not to speed anymore. Any ticket I have gotten I went in with the single goal of getting the points taken off. The way I look at it: I sped, I got caught, accept it and pay the fine.

I read this in a genlemans mag years ago. GQ! I have tried it and it does work. But it has been a while back.
Mail seperate checks for each ticket $5 over the required amount. When the 2 $5 checks return, trash them. Your tickets have been paid. The checks for the over amount are not cashed. So the system can not close and forward your driving record to your states BMV. Thats who issues the points. Seperate envelopes seperate checks. I'd say $10 bucks is worth 4 points any day!
Let us know how it works out!

It depends on whether you are more concerned about the points or the money. Years ago I got a few speeding tickets and I paid a lawyer a c-note each time but it gets amended due to faulty equipment and you pay the court cost plus a minimal fine and then the lawyer. You have no points though.

Knock on wood I havent had a speeding ticket in a while.

I don't know of anyone other than your that got 2 speeding tickets within 1 hour.

It looks like you have a few options;

  1. Pay the fine because you were speeding.
  2. Contest it in traffic court, pay some money.
  3. Higher an attorney to handle it and pay his fees.
Bottom line is it amounts to nothing more than money. If you're willing to pay you'll get off.

I actually got 2 speeding tickets in 1 hr also. My ex-wife was a judge in NY so I have some insight. I don't know what state your in so the process may vary.

You want to plea not guilty and ask for declaration (there may be a place on the ticket to request it. It may be called something else). This declaration has to be received (in NY) 5 days prior to trial. You want to show up in court in case the cop doesn't. You will usually be offered a plea bargain - take it unless your masochistic.

If I was a judge and saw someone contesting two speeding tickets within an hour of each other I wouldn't reduce the fines or points. I can understand contesting a speeding ticket if you had one and your record shows they're rare but two in the same day let alone in the same hour...no way. Just my 2 cents.

:iagree:

Send the pleas in as far apart in time as you can so you get different trail dates or request a change in trial date for one of the tickets.

I contested every ticket and have yet to pay the full amount and I have no points. I have gotten 4 tickets in my life. The last 2 tickets the officer didn't show for court so I was free to leave with all charges dropped.

1. Man up and pay the fines.
2. Quit driving like a twit.
3. Enjoy your insurance hike.

I would lock you up for wreckless endangerment. 2 tickets in 1 hour is ridonkolous :nomore:

When I was young and drove crazy I got three tickets in 24 hours. All were in different locations. I got a lawyer who specialized in traffic tickets. Cost me about $100 back then. Much cheaper than the tickets. I got to take one defensive driving course for all three tickets and no fines. That lawyer didn't seem to help much though when I got arrested for excessive speed when driving over 100 mph! My opinion is to get a traffic lawyer and SLOW DOWN. You'll eventually get tired of paying for the tickets and lawyer, gain maturity and wise up, or KILL SOMEBODY! :nomore:

30 years ago i almost got two withing a half hour driving in the sierra nevada mountains. took the first in stride and only missed the second because i was on winding mountain road and saw him way back coming on. nearly totalled my new datsun z by sliding to a stop on gravel at a sold rock water fountain for topping up radiators. stopped 1 1/2 feet from it and my heart was pounding as cop slowed to 2 mph and evil eyed me. paid the first fine and thank god i still had my license

Though I agree with the quoted words, I disagree that those getting tickets are always reckless and immature. In some areas the police activity is borderline harassment. I've seen speed traps setup right when the speed on a long straight is reduced. i've seen tickets issued for not coming to a complete stop when the car was rolling at like 1mph 3sec and the road the car was entereing was empty. A buddy of mine was ticketed for driving across a cross walk (after coming to a complete stop) because a pedestrian had put his foot on the cross walk. Some times its all about revenue and even safe drivers get nabbed.

Agreed. It's the price that you pay for your fun.

You may be educated and wiser but it sounds like you forgot to grow up.

It seems there are those amongst us who believe in the "I'm entitled" card. They believe they can speed, run red lights, blitz stop signs, drink and drive, etc and then claim cops are in it only for the money. Not that they were doing something illegal in the first place.

The fact remains that if people obeyed traffic laws then there would be zero revenue generated. Why is that such a hard concept to grasp?
