Are these rust spots? Need help

Ummm... This IS a BMW... like most cars, I'm sure it carries a rust-through or paint warranty - my KIA does... Unless it is some form of gross negligence on the owners part or some sort of industrial chemical poured directly on the paints surface... I'm sure BMW will take care of this.
 
Looks like rust to me.

Like Kristopher said, take it right back to the dealer. I think I'd demand a different car, not settle for a repaint on a 2011. I'd always wonder what is is going to go wrong on this?
 
Don't touch it! Take it right back to the dealer! All you did were washes once or twice a week-GOT IT!

If you tell the dealer that you followed any of the "suggestions" any warranty will be denied.
 
my friend's car's paint condition is in pretty rough shape. he's got holograms on his car so i'm thinking maybe the dealership put a glaze over the car so he wouldnt have noticed it at the time he was buying the car.

is this a common thing? dealerships already putting holograms on teh cars?

Yes, it is common. It's called DISO - Dealer Installed Swirl Option. Had it on my wife's brand new 2011 Lexus. Didn't let them touch it when we picked it up but then had it picked up for first service and they couldn't resist washing it even though I told them not to. I was pizzed.
