More picture stealing....

I am sure he lurks here and watches this thread like a hawk. I chatted with him awhile ago off the web site.

Good for him. If he's new to the business there's always lots to learn and that's what this forum is all about.

The way I see it is that he is certainly trying to make a better life for himself. He's just so close to being honest.

People do worse things than this for sure. I say leave him be.

I and I hope I speak for everyone on this forum, want this guy to be successful. There's a learning curve to everything in life. I hope he joins this forum, if he hasn't already and becomes an active member.

My detailing business is still super small. One person (me), one vehicle, 1 tool chest and a crate full of products. I take my own pictures (for better or worse) and they're not great but illustrate to the average customer that I do good work. My wife on the other hand has a small baking business. VERY local and very easy to spot her work. About 3 months after she started, word of mouth was getting around and she was very involved with a few bloggers and web columns. One day she got an email from one of her friends swearing that she saw my wife's work on another company's site. She went to the site and there was one of her items. No mistaking it. Only thing they had done was slightly alter the colors so it was slightly masked. It was 100% her product and 100% our kitchen. She began looking through the site and there was her item....with a description that was not even close to what it actually was. Not only did she steal the picture but she didn't even know what she was stealing. My wife emailed her but it wasn't necessary because the rest of her friends flooded the site with comments about how it wasn't her work and it was gone the next day. She was pretty mad at first, but it brought a flood of activity to her page so in the end it actually worked out.

So close to being honest? Really? Stealing pics, copying Ivan's service page word for word, claiming to be a Finest installer...did I miss something? He may not claim to have done the work in those pics but when people go to a detailers website and see detailed cars they are going to assume he did the work.

I agree with you. For those that are passionate enough, then do something about it. I stated my opinion, which is unique to this particular situation. That recommendation, by the way, in no way condones what he is doing. He certainly crossed a line. Sometimes it's better to move forward and prosper and avoid the fight. If one has the passion to argue with me over my opinion, I suggest you focus your energy on the person that is not being truthful.

And lastly, I didn't post everything on my mind nor did I illustrate what I did with this particular character.

What a terrible website, he's priced on the high side aswell. I hope his work is on par with the pictures he's posted.
 
Would be very hard to get very far with a lawsuit on simple copyright infringement like using pictures from the internet... I would imagine it costs more money than it is worth to pursue legal actions.

Threat of legal action is typically all that is needed to get someone to remove the copyrighted material from their site.

I agree with Zach. The outcome of a civil case involving simple plagiarism is normally a cease and desist. There is no punitive damage, and since it is not industrial espionage based on secret work product, the judge would just throw it out with a minor slap on the wrist. You would be out the court filing cost, attorney fees and time off from work for the judge to say "take the stuff down and don't do it again". Actually I believe that if it was your intention to ruffle some feathers that you could bring him to small claims. MAYBE the small claims judge could give you some form of compensation for filing etc... but you would have to show that you contacted him (via certified mail) and could not resolve the issue, and would have to show that the "confusion" cost you business.... very hard to prove!
 
OR you could just file a complaint with the local Chamber of Commerse and Better Business Bureau. That can so a lot of damage also if I company is trying to look good in the community. Espically if they are members of the Chamber (which I doubt he is but its still a black mark on him).
 
As a professional photographer who's had images stolen and used by someone else, i always tell people to watermark their images, drop the opacity so its barely visible, but still there. Its quite easy to do. Also, don't use hi-res images, makes it more difficult to reuse.
