opinion needed - carwash damage

here is the situation: the car has been driven to an automatic car wash by mistake , the result is that the right front fender has deep scratches(photo) , the left side half hood has deep damage too(photo) , and some very light scratches on roof , compare with the hood.
the owner show the damage to the carwash person and they say their machine didn`t do it because it should be on the whole car, so they are not responsible , plus he mention some 8psi pressure that could not do the damage ??!
as you can see in the pic most of the scratches are deep and parallel. 1/4 from damage it catch my nail.
the whole car was repainted 8 mo ago, i have 200+ , 240 microns paint thickness of the damage area show in the pictures. wetsand it may clean up , but i assume a lot of scratches will be left.
how the owner can prove that the automatic machine did the damage.
like i said the scratches are parallel , a good half of them are long too , and deep. is no way u get that from hand wash.
i would like to hear some more opinions/ solution on this situation. thank you

They are going to deny any liability right off the bat. How can it be proved that the machine caused the damage? That is going to be tough as nails. A good business owner would offer to take of the issue to avoid the bad, word of mouth advertising. It is wierd that the scratches are isolated to one area. Did the worker bees hand dry it or otherwise molest it after it was washed?

Could one of the drying towels have been dropped on the ground and picked up some grit and then wiped on the car? Assuming that it was hand dried of course.

The car wash probably has a posting that they are NOT responsible for any damage done to vehicles. This is a tough one to prove that the car wash caused any damage.

Who's to say those scratches actually occured at the car wash? Also, how do you "Accidentally" run a car through Swirl-a-Matic

Those scuffs don't look to awefully bad., and it appears you have room to work with it. I would recommend first using a rotary with heavy cut wool pad. If that doesn't clear it up, try Trizact 1500 followed by 3000

It seems to me like it was a mistake to drive to this car wash. I assume this was not a touchless wash?

Having worked in a wash before, I will say that the person that said the rest.of that side would have damage is correct. I'll go ahead and say that if they were to want to use it as an excuse, we did not cover anything not factory installed, including paint.. But I also kept my tunnel tuned well

Another thing, the 8 psi is referring to the air pressure on the air cylinder putting effort into the car, the equipment that are talking about is called a wrap BTW

About the only way that I feel you could convince anyone that the car wash caused it was if you could see if any of the scratches happen to align with the path of the equipment.

Even at that I would think any ability of the person to make a claim would go away when they drove off the lot, meaning who is to say that the scratches didnt occur some other time.

The quote ""driven to an automatic car wash by mistake"" just sounds a little strange/fishy
