well, according to the officer just quickly running his info, he has no previous record, which can just mean that he just hasnt been caught before.

I would call the mother and tell her that unless she hand delivers you cash you are going back to the police with more evidence and what not. Is the mother related to the 18 yr. old? She might just be trying to keep her kid from getting sent to big man jail.
 
Yea, I know for a fact that this is her intent. I know she has sent out the check today and I also know she just doesn't want trouble from the cops for her son's sake. I'm not sure which mother she is though (the 18 or 16 yr. old). Nevertheless, I just want the money for my damages and I'll be happy. As for the other kids involved, based on the information and evidence I will be gathering, I will decide whether to press charges or not.
 
I got my tires slashed in a parking lot once. They didn't blow out until I was doing 70 on the interstate.

There is nothing worse than scum punk kids. Wait until they have their own car and then see how they feel when people mess with it.

Even if you don't know the kids now, I say you go and get yourself acquinted with them real well.

At least the mother stood up for her child and was willing to pay for the damages. Very admirable.
 
Have you tried calling the police back and saying hey I changed my mind I will press charges?
 
im going to call tomorrow and see what the deal is with the charges, i live across the state from where it happened, so it's going to be an ordeal.

ive tried to meet these kids multiple times, but of course, they cant or they dont want to... figures, little bit****.

i wonder if i get a good enough attorney if i can puch for attempted murder, like if they would have blown out or something...

you signed the waiver - it is a legal document. there is no going back.

also, I just got the check, so that's done and over with. I'm going to see for sure thought about charges, I want to see if that paper was for at that particular instant I wasnt pressing charges and releasing the officer, or if it was waiving prosecution forever.
 
A "referal" releases the officer from the scene, waiving your rights or signing a "I don't want to prosecute" form is what is says. I would not waste my time getting a private attorney and trying to get the state to up the charge to attempted murder. Be very glad you got your tires replaced at no cost out of your pocket. I think you should let go. Next time press charges up front the first time. If you would like me to explain what I believe will happen if you try to pursue this I will.
