As I said, you've got 2 years and they know it. (They do figure however that YOU DON'T.) Heck, a kid pulled out in front of my little brother one time in a CRX on a blind uphill righthad sweeping curve causing him to T-bone him. He was driving a little Ford Ranger at the time which drove right up into the car, lifting the front wheels on the Ranger off the ground. The kid didn't make it, my brother did, but he was a basket case for months afterwards. He I don't know ever got over it but the other kids insurance company settled with HIM to keep from ending up in court. Now ME I would have never gone after his family, my brother wouldn't either actually, but the next thing he knew there was a private investigator knocking on his door, paying all his bills, giving him cash for food, and told him not to worry they'd take care of him. Honestly, it was a bit strange but obviously they'd done it before. Different strokes I guess. :dunno:
 
Tony, I'm sorry to hear all the bad news.

Venting is good but the important thing here is your wife sustained painful but recoverable injuries and will be in the pink in no time. Be sure she follows the doctors instructions and get her some physical therapy.

Everything should be paid in full by the other motorists insurance company including the damage to your truck.

A suitable rental vehicle might be in order unless you plan on taking a few weeks off while the trucks in for repair.

Take this one day at a time, make a list, then prioritize everything because it can become overwhelming...

Sorry to hear about your wife, but glad she is okay! Lots of good advice here, especially what some have said about the 2 year statute (cardaddy) and keeping a daily log (ehannigan).

I just want to throw out there that you pointed out she had "a sprained neck, sprained back, and a bruised tail bone (two days later she's still hurting pretty bad)." This may not apply to everyone but back and neck injuries can manifest in strange ways and people sometimes think they are fine, only to find out a few years down the line that they've developed a chronic issue. These injuries can also become re-aggravated in certain situations (i.e. lifting something the wrong way or straining a muscle or body part) that would not normally occur after having one of these injuries. I'm not trying to say this to raise alarms or anything like that, but just to let you know to be on the lookout for these things. Especially important when it comes to situations like this is keeping a log as that will go a long way in providing a link that anything that happens to your wife was a result of the accident.

Not everyone will have to deal with complications, but in this day and age you can never be too certain. Just my 2 cents. And again, glad to hear she is okay and wishing her a quick and speedy recovery!

So glad your Wife is faring pretty well from this accident.

If I was in your shoes...I'm sure I'd want to vent-away too.
But helping to nurse the Wife back to 100% would be my top priority.

Which causes me to say (at least for right now): "#&*%...the Truck!!"

However...Best of Luck!!...in all you do, moving forward.

I know it hurts but let's take stock. She's okay (or at least she'll be okay I hope), you're okay, the kids (if you have any) are okay, you have insurance (hopefully the guy that hit her did) and you have a good reason to buy another truck to keep shiny. Any questions???

Tony. Glad the Mrs. Wasn't seriously injured. Wishing her a speedy recovery. You can vent here anytime as far as I am concerned. We totally understand.

First off, so glad your wife walked away! She has a strong guardian angel.

It sucks about the truck, but luckily there is a reason we pay these ridiculous premiums. Upgrade on their dime!

As was already mentioned, keep meticulous records. Any & all police reports & doctors notes & charts, get copies in triplicate. Also, consider retaining legal counsel that is well respected in your area. It can be invaluable at settlement time.
 
Forget about the truck man, material things can be replaced. Your wife however cannot. Im glad she didnt suffer any further damage.

Im all too familiar with wrecks, I got hit head on at 45 mph by a drunk driver in a huge ford truck in my little honda. Help her recover and get through this tough time, because dealing with insurance, hospitals & lawyers is time consuming and stressful. Stay strong.
 
The statute of limitations for filing a personal injury suit is one year in the State of Tennessee. The statutes vary from state to state as each state has set its own time limits for filing suit. For example, Washington has a three year limit and Oregon has a two year limit for filing a personal injury suit. Hope she's feeling better.

Wow, good luck to your wife with the recovery. I wish her the bests with healing without further complications.

I am actually on this forum due to a similar phone call from last month. I was at work. We use our phones for texting only. I will check, but never answer the ringing phone because no one knows my number. I looked at it ringing and it is my wife's cell phone. That freaks me out. "Hey, rolled the truck on it's roof, we are fine." Coworker said my eyes went wide and my mouth gaped. Tried to talk to her but she kept saying she can't hear me.

We had a bit of freak weather where it warmed up too rapidly and started raining. My wife left the house and she is always looking at the temperature. It was 40°. She picked up her mom, went half a mile down the road and the roads froze solid almost in an instant when it started raining. Both of them crawled out of the vehicle without so much as a scratch. I ended up reaching her after about 50 minutes where it normally would have taken 20 minutes. It took me half an hour to crawl the first 5 miles, but then the roads all thawed like nothing happened.

Thus I replaced her Mazda that had 1 payment left with a Toyota Rav4. Upon them "detailing" it when I bought it, they swirled the crap out of the paint. Got me interested in detailing since we weren't driving crap cars any more (the Mazda was crap even though it was only 6 years old) and got me thinking about the pearl paint on it. Now I can't wait until spring to start playing with it. Oh, and my wife gets home from work and says every night, "I can't believe I'm driving that thing!" She loves it!
