Need some more info. Were you at fault? How bad is the damage? If you have a PDR guy look at it and he can do the job to good as new levels then I would get an estimate take the check not the repairs and then call back the PDR guy.
 
PDR, on many occasions, is well worth
not having to file an insurance claim.

Regardless:
I know which ever route you take...
You won't commit insurance fraud.

  1. Was blame assigned and agreed upon between both parties?
  2. Was law enforcement call and a police report made?
  3. What's your deductible?
  4. What's your best guess for the cost of repairs to your vehicle?
  5. What's your best guess for the cost of repairs to their vehicle?
 
Guy should it was minor, I said I want the policew to come out, then he says I hit him I said How I hit you now and before it was minor on your vehicle and I suffered the most damage. wait over hour for police, they took our info and give a case# and that was that, but I contacted my insurance anyway, My vehicle both rims on passenger side serious curb rash, driver side rear door, scratched from mid door to splash guard I'll try to post photo of his damage as well but having trouble, he was in a DODGE RAM HEMI 5.7 only damage he suffered was right on passenger front past head light where the hemi emblem is attached was pushed in
 
I can't blow up the pic with good resolution ,looks to me damage is on left quarter panel where it meets the bumper on the body line.I would just repair it the right way.I highly doubt your insurance will be high.If it deos go up switch to progressive,I had 2 losses paid by them and I'm in the emerald club go figure.your insurance will rise slightly higher when you purchase a new car.

Just based on where the damage is, was he merging into your lane or something? I know you explained a little above, but it's unclear what was happening at the time of the accident. Regardless, based on the pictures, I doubt there will be any sort of tickets issued. Thankfully there really wasn't a lot of damage.

I was come up a street he pulls out of apartment complex drive way i had to hit brakes to slow up and went right I blew horn and then he turns right (as if to cut me off) into turning lane I jump curb to avoid impact but still got clipped, I guess he figure he is in a truck and rule the road. just glad no one was on bus stop at time
 
he pulls out (like a mad man) complex jumps out like he wants to beat the light but then turns right as I'm coming into turning lane to block me, if he was going to turn right at light why not have turned into turning lane from (very beginning) exiting the complex lot. so glad I forseen the last moments and did not hit poles or tree

The laws are different in every state, but here's how it works in CA. The police always assign blame, even if they don't outright tell you at the time. This is why, if you aren't at fault, it is always important you wait for the police and get a police report. It's even more important if you are not able to agree with the other party on whose fault it is. Even if you do, still get the police. People can not be trusted in these situations to tell the truth later. Law enforcement will (normally) first write up the person who is at fault and will follow with the other people involved. That's how you can tell who they are siding with IF they decide not to tell you. A case number will be assigned and that is something that your insurance company looks at. Your insurance company will then take all information (which may include interviews from you and the other person) and blame will be assessed. If you are found not at fault, all is good. You pay your deductible. Sometimes you don't even need to pay it if it's clearly not your fault. Sometimes you get it refunded after several months. You get your car fixed. Everything is done.

Here's how I would determine what to do. If you are clearly not at fault, are sure your insurance company will find you not at fault, and the damage is more than your deductible (which is clearly will be from your images), I would go with filing a claim with your insurance company. The entire point of having insurance is to not have to worry about when these things pop up, so utilize that.

Pdr may improve that,but I would aim for 100 percent cause it's a nice car.The body line is dented hard to fix by pdr standards.

Thanks glad I called my insurance company a rep will be contacting tomorrow, now I have to get my own copy from police of the report

Thanks, I hit it with M105 which produced an very nice visual appearance to make the damaged area less noticable while parked or driving but still some chipped paint, since I reported to the insurance company I'll just go that route, was trying to avoid the deductible and higher rates for being involved in an accident, again thanks for the compliment on vehicle and your valued opinion.

Yup. Keep your bases covered. The other thing that will keep you at ease is the arbitrators assigned to your case, they've been doing this for years. They can tell just from looking at the damage who's fault it is.

Here's the other good thing about insurance companies. He might tell a different story to his company and his company might find him not at fault where as your company will find you not at fault. That's fine. As long as your insurance company finds you not liable, all is good. You'll get your car fixed and be on your way. Meanwhile, the two companies will then fight over who is liable, but you'll never know the outcome and it won't matter because your case is already closed on your end.
