With all due respect: When you compare the difference in price between a tub of AG wax and a Civic hybrid you realize that your analogy is far from "apples to apples"
 
The interesting aspect of this case is she is going through small claims court rather than joining an already in progress class action suit where the lawyers end up with most of the money.

I think he was just trying to say the concept of a company claiming something and customers not seeing those results. But I see what you mean.

They just had a news report on it. I think she's crazy. :o

If she wins the case, it will be a big event in the automotive industry. Then the EPA will have to put even more notices about gas mileage.
 
What would really grate my nerves would be if she was a member of these monthly fee legal companies that exist today (Pre-Paid Legal). I picture these people sitting on their couch calling their service ... "Hey, sue these people for me!"
 
I'm with you. I hate sue people happy, but this lady is legit.
  1. It's a recognized issue.
  2. She's legitimately not getting what is stated, or anywhere within the "as high as" and "as low as" numbers.
  3. She spent money on a product that did not perform as advertised. While it's easy to say suck it up this isn't a 20 dollar wax we're talking about, it is a 20k+ vehicle. She paid a premium to save money in the long run. Not to get something that isn't doing what it should, and it's completely unreasonable to think that SHE needs to take the hit by trading it in because honda screwed the pooch.
  4. She's tried being reasonable and has tried negotiating out of court to simply swap out her vehicle, as well as for smaller sums than she is currently asking.
  5. She's only asking for enough money to offset costs incurred. She isn't looking for some ridiculously over inflated sum.

Is what she's doing that unreasonable?

Nothing's she's doing is unreasonable. She just happens to be an attorney, and by the way; when did we start believing car manufactures and dealers?

There seems to be an ever growing number of complaints that manufactures in general are overstating their City and Highway estimates by as much as 50%!

Now, while driving habits certainly will cause these "estimates" to vary, the best this woman's gotten with this green machine is 30 miles per gallon.

This is a far cry from the 49 City - 51 Highway on the sticker....:bat:

I can say with complete confidence that if you were truly dissatisfied with a wax not living up to its expectations the manufacturer (any good one at least) would stand behind their product. No need to sue if they remedy the situation...something Honda has clearly decided not to do.
 
This morning I heard on the radio that the car she was suing about was a hybrid but the car was older and the batteries were the stockers. Not holding their charge as long as they should resulting in the crappy gas mileage. So now that the car is older it does not return the mileage so she is suing.

I don't know if this is the complete story but if it is, I would have never guessed that you could sue over a dead battery. Its a litigious happy society. Watch some TV one afternoon and see how many lawyer commercials there are for crap!!
 
I saw a bill today for someone our company got a business visa for travelling from US to India.

visa application/expenses and incidentals: $350
lawyer fee: $2500

what the???

the lawyers, ceo's, and their cronies are killing our countries...

The 2008 Civic is rated at 40/45. Exact same car the only change was EPA testing guidelines. The Prius took a hit also.

Seems the issue is with the EPA.

How close to the estimated mpg would be acceptable? And what number should be used to
calculate how much extra gas she had to buy? Actual vs. city, or actual vs. hwy?

I found a press release on her website, included in the damages is the "Hybrid Premium" she paid over sticker. I reread it a couple of times to make sure it wasn't referring to the
difference in price between the regular Civic and the hybrid Civic. But no, she thinks Honda should reimburse her for having poor negotiating skills.

BTW the court date was yesterday. Anyone know how long it takes to reach a decision in small claims court. I assume cases can't be drug (or is it dragged) out like in a regular case.

Im not sure if it was mentioned, but someone sued Capn Crunch because they were under the impression that the berries were real and and not made of cereal...

While our society is a very judicious one, from the little I read about this lady IMO she had an honest gripe.

It said on yahoo news if all the owners did this, it could cost Honda around 2 billion. (and the lawyers wouldn't get most of it in fees).

Remember the good old days, when auto makers used to understate the horsepower on cars so people could get insurance?

I read a story in my area where a guy in my area sued Verizon and got 5k awarded to him in small claims court. Last I heard, it had been 5+ years and he never got a penny.
 
Wow.. That case won? That's it, I'm suing Volkswagen because they claim my TDI Jetta gets 40 mpg and I'm getting 60. I'm suing for emotional and physical damage of having to hold my bladder longer than I expected, so inhumane of Volkswagen!
